Overview
This is a service agreement between Mokka Labs Ltd and users accessing their talent acquisition platform. The document consists of an Order Form and Framework Terms incorporating Common Paper Cloud Service Agreement Standard Terms Version 2.1.

Pilot Program Terms
Before paid subscription, customers may participate in a 14-30 day evaluation period with these conditions:
- Non-exclusive, revocable access for evaluation purposes
- Data processed per Privacy Policy with "reasonable safeguards" but no guaranteed security
- Both parties must maintain confidentiality
- Services provided "as is" without warranties
- Provider not liable for damages from pilot participation
- Customer feedback can be used for product improvement and marketing
Subscription & Payment
Pricing: Available at www.gomokka.com/pricing; subject to 30-day notice before changes
Payment Process: Automatic billing authorized on file; payments may direct to Mokka LLC (subsidiary)
Renewal Notice: 30 days before subscription period ends
AI-Assisted Candidate Evaluation
The Cloud Service uses artificial intelligence to evaluate candidates on Customer's behalf. This section describes the shared responsibilities for regulatory compliance.
What Mokka provides:
- Independent annual bias audit conducted by a third-party auditor, with summary results published at https://trust.gomokka.com/
- System-level documentation describing the AI scoring methodology, data inputs, and assessment factors
- Human oversight design — AI scores are decision-support tools and do not make autonomous hiring decisions
- Data export capabilities for candidate scoring records, assessment data, and evaluation results
- Zero data retention on third-party AI model provider servers after processing

What Customer is responsible for:
- Providing candidates with any required notices before AI-assisted evaluation, in accordance with applicable laws in Customer's and candidates' jurisdictions
- Ensuring a qualified human reviewer evaluates AI-generated scores before making hiring decisions
- Responding to candidate rights requests regarding AI-assisted decisions (e.g., requests for explanation, human review, or alternative selection processes), with Mokka providing reasonable technical support upon request
- Exporting and retaining AI decision records as required by Customer's applicable regulations before any data deletion
- Determining which AI-related laws apply to Customer's use of the Cloud Service based on Customer's jurisdiction and the jurisdictions of candidates evaluated

Liability Caps
General Cap Amount: 0.2 times fees paid in the preceding 12 months
